Why did a Shithead go to the court case? Apparently he's training to be a barrister and has seen the court papers. If he's that indiscreet, he's more likely to finish up as a barista.

It's interesting Sainsbury's are suggesting we couldn't afford to buy the stadium as I wonder how TW is going to get around that problem, given NH's recent plea to Bahrain for help in financing the build?

I've a feeling the OTIB poster is some how connected to the case as how else would he get access to the papers? Perhaps he's a trainee working for one of the firm of solicitors or even the court itself? Odd he's stolen the "cider" tag from our 7cider as well? Interesting Sainsbury's are suggesting we couldn't afford to buy the stadium as I wonder how TW is going to get around that problem? in the same way he cures his constipation. He'll get a pencil and works it out.

No the point is that according to the court papers there is a specific clause in the contract saying that the net sale proceeds for the mem must exceed the projected build cost for the UWE. This is important for Sainsburys as they would not want to be stuck with sitting tenants if the club couldn't afford to finish the development and vacate the mem. Based on a funding calculation provided by the club in December there is a shortfall. As I said on the other forum, it is interesting that this has not yet come out in the verbal exchanges and Sainsburys did not highlight it in their opening statement to the court. If the directors are going to fund the shortfall they can easily build this into an updated funding calculation so maybe Sainsburys do not see it as the cornerstone of their defence. So far they have been focusing on a cut off date and we seem to be doing a reasonable job in proving that it was missed because of their bad faith and failure to apply best endeavours.

Probably not come out as its easily rectified. Stadium could still be build minus seats in one end or side, and fitting of gym not done until a later date. None of these things would stop rovers moving in freeing up the mem but in all honesty, the shortfall would probably be covered by the directors or investment. I think it's great that the build price is finally in the public domain as its clear to see that if we get the 30 million then the ground is affordable. There was lots of talk of having a 3 sided kassam as the figures didn't add up. Well clearly they do. uTG

We cannot build a three sided stadium or any other variation without a new planni9ng application.

Still not sure if the stadium build cost exceeding the Mem sale price is that big an issue as surely Rovers will say it's only exceeding the sale price due to delays caused by the JR, which is down to residents challenging building the store. Unless the contract states that at all times the sale prices must exceed the build cost until completion of the staduim, which is hopefully not the case. Plus I assume the BoD can fill the funding gap from somewhere.
What is a bit baffling is the OP's reference to the £30m paying for the staduim build along with paying off the Directors loans of £6m-7m, as surely the staduim was always going to cost £30m to build?

But what if we start building get three quarters completed and then run out of money? Port Vale have a half built stand for this reason.
