From what the new Board are saying about the ground will be sold to help finance the new stadium the court has already notified the league teams of its decision.
Prior to the take over this may well have resulted in administration which would have been a travesty given the progress on the pitch.
Thank goodness for the Al-Quadi family and the AJIB.

What happens "if" we win? Do Sainsbury have to buy The Mem, or, do we just get a bit of compensation?
If they do have to buy it, can we stay put while the UWE gets built, or do we have to get out asap?

If they do have to buy it, can we stay put while the UWE gets built, or do we have to get out asap? They wouldn't have to buy it, it would be about compensation. But even if they did end up buying it (ie honouring the contract) that contract specifically says we don't need to move out until a competitive match has been played at UWE.

OK cheers, do you know roughly how much compensation it could be? Are we talking 100's of thousands, or, lots of Millions?

You'd think it would be based on how much we could have won, rather than how much we've lost though, otherwise there wouldn't be much point.

From the description of the appeal proceedings, we argued our case for a full day. Counsel for Sainsburys stood up and said "Whatever" and that was it.
I can see the unbeaten run ending on Thursday.

Would really like it if we did actually win - it would mean NH was vindicated in following his legal advice - it would show Sainsburys they can't keep promising to buy land with no intention to build just to stop competitors and it would give the new board monies to spend in progressing their new ideas they might not have expected. Here's hoping but I won't hold my breath because us Gasheads have probably used up all our miracles at the mo

Not quite sure where all these variances of opinion come from. The judgement will say if the contract is enforced or not. If we win, Shamesburys will be made to buy the stadium site for £28m or whatever. If we lose, which is highly likely, then we get to find out Higgs true legacy i.e. The costs of everything.
Compensation doesn't come into it as far as I am aware. It's basically all or nothing.

With regard to the stadium sale, that is a matter of common sense. The land value for housing is massive compared to the value of a prospective new training area further afield.

Ended in breach of contract From the judgment: The contract (comprising the original contract and a supplemental contract) is, where the context admits, compendiously described as “the Agreement” in this judgment and some relevant parts of it are annexed. Sainsbury’s case is that it has lawfully terminated the Agreement for non-satisfaction of conditions precedent; the Club’s case is that the Agreement is either still on foot or it has been terminated in breach of contract.

What a difference a month makes. There would have been alot of sleepless nights this week if we were still under the old stewardship. I have no doubt that Thursdays announcement would have quickly been followed up with the club going into financial meltdown. MSP loan to be paid back Charge over the stadium for Sainsburies costs Directors loans. Just one big grab for cash from those who steered the ship directly into the perfect storm. We would be on the verge of being homeless again with no opportunity of sharing at Bath this could have been the slow death of the club suddenly moving into the fast lane to oblivion. Instead the future is so bright im still pinching myself. For the first time in my lifetime there is a prospect that we will be able to compete with the other team in bristol off the field. UTG

UTG I think a month ago we'd have all been resigned to losing (or maybe vaguely hoping against hope for a last minute equaliser), but now suddenly, even though the takeover has nothing at all to do with this, it wouldn't be surprising if we actually won.

UTG Exactly this. I have gone from nervousness to just wanting this to come to an end and seeing what the new owners have in store for us in a positive way. It will be interesting to see what form a club statement takes, assuming we lose, in that will it be a holding statement - "we need to take stock of the judgement" or will it allow a statement on more detailed plans to be announced? It would be lovely to think an announcement on plans would be made shortly afterwards ready to steal the headlines going into the weekend. More good publicity for the club in the weekend edition of the BP and maybe even some national sporting headlines on the inside pages.
