He’s simply not going to do that though is he? Nobody ever does do they? Andy Webster did. It’s few and far between though. I doubt he’s got a years salary just sitting around as well.

Are there not other rules to stop players doing it though?? For example, you can't sign for another club straight away. Or you can't receive a signing on fee bigger than what you pay off. Or you have to prove you paid it and hit another club etc. Or you have to be not starting games etc. Just guessing, as I've never heard of this happening before and didn't think it would be that easy. When Kane wanted to leave, Spurs were playing hard ball and there was no mention of this rule. He was stuck there for years. I think it is a complicated process which puts off the player/club from going down that route, but with a player like JCH it seems to me the only likely compensation payable would be the years contract and wouldn't matter if you received a signing on fee bigger than what you pay off. That is for the lawyers to determine though and beyond my understanding. As for Kane, Article 17 was mentioned at the time of him being linked with Man City (apologies for linking to a Sun article)... All of the links from the Wikipedia page are from years ago and I couldn't find the rule in the FIFA rules, that I just looked at. There was a rule saying that a player can't break a contract during a season though. All seems complicated, that article regarding J Kane, could have been using old rules?? Has anyone finds it recently and is it still in the rules??

I can't see where it only applies to under 23's? As in previous cases, a player who signed a contract before the age of 28 can buy himself out of the contract three years after the deal was signed. The window is shortened to two years if he is 28 or older. Players must give notice that they plan to use Article 17 within 15 days of the final league game of the season. This is an article from FIFPRO World Players' Union just 3 years ago. For Article 17 to apply Article 15 has to be triggered, given that JCH is being regularly picked for 1st team duty, unlike Webster who was dropped, then it can't possibly apply:
"15 Terminating a contract with sporting just cause An established professional who has, in the course of the season, appeared in fewer than ten per cent of the official matches in which his club has been involved may terminate his contract prematurely on the ground of sporting just cause. Due consideration shall be given to the player’s circumstances in the appraisal of such cases. The existence of sporting just cause shall be established on a case-by-case basis. In such a case, sporting sanctions shall not be imposed, though compensation may be payable. A professional may only terminate his contract on this basis in the 15 days following the last official match of the season of the club with which he is registered."

He’s on a rumoured 7.5k a week at Posh. I doubt Rovers are paying that much. McAnthony won’t sell to a league one rival for peanuts either, he’ll wait it out and lose him for free if he has to; JCH could be the difference between them going up or staying down. I suspect he may end up available on a free next summer where he k owns the wages on offer will be more He's on £6,100 per week at Peterborough and in 7 days enters the last year of a 4-year contract hence being able to then buy himself out of the last year of his contract for £317,200 as per Article 17 of FIFA's Transfer Regulations. Other than the legal complexity of that I highly doubt JCH has £317,200 burning a hole in his back pocket!

That wasn't the clause for Webster and it wouldn't be for JCH. You are quoting Article 15, but it is Article 17 that is relevant.

As I posted before, it has been intimated that few clubs have tried this method due to the often unspoken agreements between clubs not to manipulate the system. It is also a complicated process and not just a case of paying up the last year of contract and then walking away. Basically, upon the completion of the third year (in 7 days time) of his terms he needs break his contract with Peterborough. It's at that point when FIFA's 'protected period' (no sporting sanctions) ends and he would have to inform Peterborough of his intentions (within 15 days of the club's final competitive game of the current campaign). If JCH does that, Rovers and Peterborough would then have to sit down at the table with the aim of reaching an agreement. If the two clubs cannot reach a deal here, FIFA would try and resolve the case as they did with Webster. If either of the clubs disagreed with the ruling, they would then reserve the right to appeal to CAS. It is this unknown that is probably preventing more clubs from exploiting the loophole. I think because of the profile of player, it would be similar compensation to the Webster case and JCH/Rovers would he liable for just the last year contract, but even if we had to pay more I can't see it being anywhere near the what any prospective club would have to pay in a standard transfer fee for the player.
