Last time I was in Sainsbury's I bought 2 Krispy Kreme doughnuts but scanned them at the self serve as the poxy own brand rubbish. Saving me the grand total of around £1.40. See you in court. Might be a little after the event but the Planning Process is flowcharted on the Planning Portal website; www.planningportal.gov.uk/uploads/plan_flow_chart_eng.gifIf I'm reading it correctly the process finishes with a right of appeal to the Secretary of State. Lose that, then you must start again. As this is a government site, it must be the truth!!!

The definition of when the application process ended. It should be simple but all of the appeals made by TRASH etc, and the delivery hours confused the issue. There was an initial refusal on delivery hours but then we successfully appealed. So, did the process end before or after our successful appeal? exactly. Using a common sense approach, it would seem crazy to see something as 'over' until all appeals were over and there was nothing else that could be done. As a simple example, think of the Judicial Review. It had very distinct stages to go through, with precise time frames. Once those stages and time frames had been gone through, it was 'over'. The problem with the case is of course that this is contract law, and not common sense, AND that this is about a specific contract between only 2 parties, and not a generic country-wide process like a Judicial Review. Also there are questions over the application for a change in the delivery hours.

I'm just cracking up at the idea that Sainsbury's barrister goes home at night and reads this forum in order to find pithy comments he can use in court. and to think many on here said we can say what we want and nothing we say on the forum would be used in court. it's meaningless though. this is a Court of Law, not a gossip corner, and the decision will be based on evidence and Contract Law.

Surely appeal is just part of the process. Also,that When is a cut off quote was lifted off here. Hello Sainsburies. Did you lie to me? I will never shop with you again and I urge 30,000 other to do the same. Apologies if I'm repeating other peoples points, but this has to be one of the areas, if not the area, that this all hinges on.
So, Sainsbury's are saying that the Planning Application was rejected initially and so that ended the process and so any agreement with BRFC. I will be extremely disappointed and disillusioned if the Judge agrees with this - after all every time one of these large companies wants to develop there is nearly always an initial planning rejection, often after public or other objections, and there is always an appeal with or without some modification to the application to ameliorate any points made in any objection. My impression is then that 9 times out of 10 the Planning is approved upon appeal.
If Sainsbury's are now saying that they would pull out every time at the initial rejection point, they probably wouldn't have been able to build any of their large or small shops in the past if they had followed this approach.
Come on our QC - show how weak this argument is, and Mrs Justice P - please give us what we need to take BRFC into the future.
Spot On. Supermarket giants got planning permission when they wanted it just by persisting with the legal process knowing that a local authority had a finite amount of resources and could not be seen to waste tax payers money. Thats why so many out of town stores went up after the initial planning permission was refused .
