So according to the evil post we're back in court on Friday for the next step of the appeal process. The piece of the article that I never knew about is where it states that even if we were to win the appeal then we would only be awarded damages and sainsburys not be forced to complete the deal, am I the only one who didn't realise this? So this is looking more and more like a case of NH just trying to get his money back, because even if we were to win we wouldn't have anything near enough to build anything anyway. m.bristolpost.co.uk/Bristol-Rovers-court-Sainsbury-s-ruling/story-27508323-detail/story.html

You can't read much into what the Post says. After all, they got it all wrong in the second line where they state Rovers took Sainsbury's to court !

Although little point in worrying about that until we get leave to Appeal then actually win the Appeal.

How would Shamesbury's have appealed then, they couldn't have claimed damages if they lost, could they?

Not really worth risking the clubs future over a few mill . The uwe isn't going to happen weather we win or not . Very irresponsible of Higgs and co to gamble in this way .

Nothing new in that article, all old news. Apart from the bit about there being a hearing on Friday. And the bit about only getting damages as opposed to fulfilment of the contract?

Do you know of something else? Is there actually a plan B? Because from the outside it looks pretty dead TBH.

Both were reported in the Post the day after the verdict. I mentioned it after reading the paper on another thread at the time.

I suspect it's a load of bull in the BP. Higgs is asking UWE to stick with us through the legal process and why would that be so if there's no chance of a successful appeal generating sufficient funds for the stadium?

I would hope that if we got damages they would reflect how much we the claimant have suffered financially which in this case is the 30m we need to build uwe. What I actually think we will get is another legal bill.

Not really worth risking the clubs future over a few mill . The uwe isn't going to happen weather we win or not . Very irresponsible of Higgs and co to gamble in this way . I posted this in another thread... I've been reliably informed, that any legal costs incurred from the appeal are being waived.
Shamesburys cannot appeal against the outcome of the appeal, so if its not costing us anything we would have been daft not to have appealed.
