Topper - I am not sure if NH said this in the open meeting or in a private discussion, but he inferred that he did not expect an appeal to be made to the Supreme Court by either side.
If his assumption is correct, it is all on nothing on the Appeal in January.
I noticed one of you posted that but if Sainsbury's lose then that could open the floodgates to the other 40 property developers pursuing similar claims against Sainsbury's alone. I just sense NH is being a bit naive if he thinks Sainsbury's won't seek a further appeal if it could save them £100m's, although we find out one way or the other early next year. Not all of the 40 investors are going to successfully appeal and it would be bad for sainsburys pr if they dragged the case on any longer, it certainly wouldn't save them £100m's

Topper - Having spoken to someone else who was present when NH make his remarks, they do not use social media, NH said that BRFC would not go to the Supreme Court if we lost - but we are not going to lose are we - and that he doubted Sainsbury would either.
There was a surveyor at Court in May who was working on behalf of a client on a cancelled development and he told me that he was there to advise his client how the case progressed and the legal arguments. So yes, there are clients let down by Sainsbury/Tesco/Morrison etc who will be very interested in the Courts decision and could pursue a future claim.

Not all of the 40 investors are going to successfully appeal and it would be bad for sainsburys pr if they dragged the case on any longer, it certainly wouldn't save them £100m's Why wouldn't it save them £100m's NH wants £35m plus costs for our claim alone, even if just 10 other property developers pursued claims that could be another £100m/£200m. Surely if Sainsbury's were worried about bad publicity they'd have played fair with us already?
