That was pre litigation I assume Sainsbury's are saying they can't wait for ever and if Rovers still want there £30m they want vacant possession before handing over the money, just in case we never move out! and would Rovers want to do anything that might give Sainsburys a further excuse? interesting points raised ,but if it's a condition of the planning permission, it's doubtful if it can be changed, and lets be honest it's not our fault the timescales have changed, would sainsburies really want anymore adverse publicity

Not really a specific reply to you lulworthgas but to all in general...it doesn't matter if we get the decision on Wed this week or in Feb next year (unless the club lied to us about the conditions of the contract....they said - and correct me if I'm wrong, please don't sue me) the UWE takes 15+ months to build, so we either start before April 2016 or we give up... Also, I'm sure I read that we wouldn't leave the Mem until the UWE was completed.... I'm sure that in the planning consent or the contract there was a bit saying we stay at the mem till Uwe is completed and shameburies, couldn't touch the mem until we played our first game That's what everyone is assuming, but it is NOT what was said in Court.
We have to abide by the Contract Conditions and to be honest none of us are aware what it says, even if certain individuals have suggested otherwise.
TW told the Court that we have used other grounds in the past and that this matter "is taken care of" or words to that effect.
Yes, I see where Sainsbury are coming from. If they have to pay us £28.4m, irrespective of any costs, they may wish to dispose of the site fairly quickly and it is better without a "sitting tenant".

I can't see how Sainsbury's can change the terms of the contract and now say they'll only pay up if they have vacant possesion? Unless the UWE ins't going to start stright away once Sainsbury's pay up, if not, you do wonder if it will ever start if we ever leave the Mem and find a new home?

A peppercorn rent Is basically an extremely low rent. It is just a minimum payment to allow you to stay in situ for practically nothing. Legally to allow you to stay there for practicaly nothing.

I have heard statements from BRFC, but have never heard "the contract says we can play at The Mem whilst UWE is being built, at a nominal/peppercorn rent". I was hoping to see NH/TW on Monday but there was never an appropriate time to ask them that and the comment made in Court about the Naming rights.
If I get an answer, I'll update you all.
