No, as I doubt Sainsbury's will force us to sell them the Mem for £30m when they don;t want it? Although we have no chance of winning anyway.

Well I would imagine if we could collect 30M they would have their hand snatched off, but I just wondered if the UWE is moving in the right direction and we were forced to sell by the appeal decision, would it affect any plans in place i.e having to find somewhere to play or even Wael might have other plans /ideas for the Mem Would it suit to sit tight at the Mem whilst UWE is built at a pace to suit us Can we sit tight if the case is won

Yeah, but if the contract is seen to be valid in regard to Sainsbury's buying the land, then it is bound to be valid in regard to us getting to stay there until UWE is built. In any case, iirc, in Proudman's summary she said that she would be looking at whether the contract was still enforceable or it had been broken. So I imagine if the ruling does go in our favour (fat chance) then the judge will state whether the contract can still be enforced, or we will be due compensation for Sainsbury's breach of contract (or both). I imagine, if the contract is still enforceable that we could still come to an agreement with Sainsbury's if they want to buy themselves out. All this is probably irrelevant though, as I doubt we will win. IANAL

First 3 responses on the thread: Yes, No, Why.. Sure this has cleared it up for the OP. The court case is quite simple. It is to decide if the contract is enforcable or not. The contract stated that we would stay at the Mem until the UWE was complete. Any money paid by Sainsbury's HAD to go towards the building of the UWE. The correct answer to the OP is 'Yes'.

I'm sure there's an estimated date for when in March the appeal decision will be announced, but I don't feel inclined to troll through pages of threads to find out. Does anyone remember what the date was?
