An independent arbitration panel has upheld a claim from the Professional Footballers’ Association (PFA) that the EFL was in breach of the constitution of the Professional Football Negotiating and Consultative Committee (PFNCC) by introducing ‘Squad Salary Caps’. In August 2020 following an extensive and comprehensive consultation process with EFL Clubs, Leagues One and Two voted to adopt new financial controls that replaced the previous Salary Cost Management Protocols (SCMP). The PFA argued that the PFNCC’s remit to consider matters relating to the employment of, and any associated rules and regulations to professional players employed by EFL Clubs, was not properly considered as part of the process to introduce the new rules and as a result served a notice of claim to that effect. The EFL and PFA then agreed to refer that matter to arbitration and after hearing submissions from both parties, an independent panel concluded that the EFL was in breach of its agreement as a member of the PFNCC. At the time of the adoption of the Salary Cap Rules, the EFL included a provision to ensure that any decision such as this would have the effect of reinstating the SCMP rules that were in operation during season 2019/20, which links player related expenditure to turnover. Hardly news that benefits the majority of clubs in leagues 1 and 2 and I include us in that majority. It’s meat and drink to badly run clubs like us and Sunderland so we can rack up heavy debts again chasing mediocrity. Accrington can do with £5000 what we can’t do with a million and instead of trying to be like them the clubs take the cop out option of demanding their right to spend their way to success. It’s like treating depression with a drink and drugs bender.

Seeing as SCMP is a figure based on income, presumably every club in the 3rd or 4th tier will fail the SCMP limits this season. Will this mean every club will be penalised or is it a free hit?

How the hell is that going to work now? Will they take into consideration the Premiership loans/penalise the clubs who haven't taken out the loans?

"FL Turnover figure includes donations from the owners to the club and injections of equity. Loans from club owners are understandably not included in the Turnover figure as these would result in growing up club debts. In League 1 and League 2, a wealthy owner can therefore fund the club spending in a way that is not permitted in other divisions" www.financialfairplay.co.uk/scmp.php
