Perhaps his lawyers have asked for the case not to be listed on the public list? On what grounds? Terrorism? Protecting minors? Perish the thought you might be speculating based on nothing. What's the harm with speculating as to why it's not list, it's hardly going to affect the outcome of the trial, should it go ahead tomorrow.

This case just shows how stupid the law is sometimes in this country, what about some common sense in law these days ?
Man turns up in court with wife arm in arm and he is being done for attacking his wife.....
What a complete waste of time and money, except if you are a barrister then bring it on !
on another theme its being reported that over 50 homeless people live on the streets of Bristol, why is the CPS not prosecuting BCC under the human rights act...

Sounds a bit of a fiasco already...
False start The district judge is in and the very first thing Helena Duong says is ask for an adjournment, and this could be significant.
Ms Duong, prosecuting, says that today she's seen a letter sent to the Crown Prosecution Service on February 17 by Joey Barton's wife Georgia, who then didn't hear anything back, so followed it up with emails to chase it up on February 24 and March 3.
The contents of this letter haven't been disclosed, but clearly it's pertinent to the case. Mrs Barton is Joey Barton's wife, is here today outside the courtroom in support of her husband, and is also the alleged victim in this case.
Ms Duong has asked for a 15 minute adjournment, which District Judge Sweet has granted, and she added that she needed to discuss this letter with CPS solicitors, and also said that it was likely that the defence would make submissions afterwards.
What happens next, no one is quite sure, but we wait a little bit longer for this trial to get underway.
CPS 'inefficiencies' Defending Mr Barton, QC Simon Csoka is not best pleased with what's happened, pointing out that no one from the CPS got back to Mrs Barton to acknowledge her letter, or got back to her when she emailed twice again asking if they'd received it.
We're taking a short break while they sort this out. The court usher is meanwhile checking the TV monitor works, because the case will involve a police video, we understand.

The prosecution obviously have some evidence that is not immediately obvious. Dont the officers wear body cam nowadays?

We're back with legal argument We're all back in court, and things are getting complicated.
The CPS said that they intend to go ahead with the prosecution, but we now have Mr Barton's QC Simon Csoka arguing to the district judge that things have changed.
What's changed is that Georgia Barton has offered to give a statement to the police, something that hasn't happened as yet.
Mr Csoka said is that the police should now take a witness statement from Mrs Barton, and then a decision taken around what happens next. And that will also mean the ruling by a previous judge that Mrs Barton doesn't need to be called to give evidence in the case, should be reconsidered.

Prosecuting, Helena Duong outlined what's happened in this case, in an attempt to convince the district judge that the prosecution should go ahead regardless of Mrs Barton's new offer of a new statement.
There had been a previous ruling that the prosecution doesn't need to call Mrs Barton as a witness, and to only rely for the basis of their case is the 999 call made by Mrs Barton at 11.14pm on June 2, and the body-worn camera footage of her talking to police officers when they arrived at the house at 11.38pm.

'Lump the size of a golf ball' on her head Outlining the case for the prosecution, Helena Duong said Mrs Barton called 999 and said she has been hit in her house by her husband, and asked for police to attend urgently.
They arrived at 11.38pm and spoke to her outside. "She gives her first account of what she says has happened," said Ms Duong. "She said she has gotten into a drunken fight and her husband has pushed her down. 'He;s got my head and pushed me down and kicked me in the head'," Ms Duong says Mrs Barton told police at the time.
This is what will be viewed in the police bodycam footage.
"The video shows injuries, a lump the size of a golf ball on her forehead. She puts her hand up to it and there's blood - she's also got a bloody nose," Ms Duong added.
We're still in legal arguments about all this...

This should go ahead as stated, say prosecutors Ms Duong continues outlining what happened on June 2.
"Mr Barton was asleep upstairs when police arrive and he is arrested, and is still intoxicated," she said.
"He gave a 'no comment' interview the next day.
"The issue in this case is that Mr Barton denies assaulting his wife at all. Mrs Barton's letter is what she now says is what happened, is in stark contrast to, and is contradictory to the account she made at the time to the police," added Ms Duong.
"We don't propose to obtain her account, there's nothing to stop the defence obtaining a statement from her or calling her as a witness. The Crown doesn't propose to take a statement from her - she's given an account eight months later and it's plainly an attempt to exculcate her husband," she said.
"The Crown doesn't take a different view now."

Imo if he kicked her in the head, he would have killed her. You can't get a lump from falling and she was drunk. People lie when they are drunk in the heat of the moment. The other two attending will be the best witnesses. Only the four know what happened.

i suspect that the Police feel that her statement will weaken their case and dont want to hear it. they will conclude that she has been influenced by JB . I am not sure how they can argue that the evidence of a drunken person is more reliable than someone who is sober though
