Yes, I'm no expert but I believe with these 'either or' offences if it goes to crown court it's in part because the likely sentence (if found guilty) exceeds the six month limit at magistrates courts If this is trialable either way, then initially the defendant elects Mags or Crown at the initial plea hearing in the Mags. If the defendant elects Mags then the Magistrate decides whether they accept the case or whether they pass it up to Crown. If found guilty Crown can pass heavier sentence. I haven’t followed JB’s case but either he elected Crown or the Mags passed it up to Crown. Advantage of Crown is usually greater accuracy of law and procedure being observed. Downside is if found guilty. If he elected Crown, his legal team must know what they are doing Conviction rate is higher in Magistrates courts than with a Jury in Crown Court. If you have the money then Crown Court offers better chance of acquittal.

... and apparently any other case with a wealthy defendant. I’m thinking if we had him on our side in the Sainsbury’s court case not only would we have won but we’d have been given half of their South West property portfolio as compensation and somehow wangled it that Bristol City were not allowed to be resident within 50 miles of Frenchay! Then gone bust when his bill arrived!

Only thing that troubles me about this is the fact it’s at crown court, probably because of his previous. If it was at a magistrates it would be a lighter deal IMO. Better chance of acquittal at Crown Court.

How long does it usually take for the jury to be sworn in? When I was on jury duty it took forever, there were 20 odd of us sitting there listening to the charges in great detail (was an 80 year old bloke accused of fiddling with his granddaughters in the 90s) waiting to find out if we were going to be one of the 15 to actually be in the jury for the trial, then we went away then they called us back and we thought this is it, who's going to get chosen, only to be told he'd changed his plea and we weren't needed, took about 3 hours!

You seem to know a lot about such matters. There's a prison in Pucklechurch isn't there? Hmmmmmmm. You are Rose West and i claim my five pounds. HM Prison Ashfield (formerly Pucklechurch Remand Centre) is an adult male sex offenders prison. Oh great. Thanks for that.

I wonder if Joey watched the new BBC drama last night Time. Blades fan and football player Sean Bean has got a spare bed in his cell after the demise of Bernard. There are some nasty scousers in that prison which Joey could sort out !

He better be hoping Ben Garner hasn’t had anything to do with the assembly of his legal team.
